01Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of the website located at https://modernfiberart.com/ and any related content, features, or services (collectively, the “Site”), operated by Modern Fiber Art (“we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Notice and Cookie Notice, each incorporated here by reference. If you do not agree with these Terms, you must not access or use the Site.

02Eligibility

The Site is intended for users who are at least 18 years of age, or the equivalent age of majority in your jurisdiction. By using the Site, you represent and warrant that you meet this requirement, or that you are the parent or legal guardian of a minor and consent to that minor’s supervised use of the Site.

We do not knowingly collect information from or direct our Site to children under 18.

03The Site is informational and inspirational

Modern Fiber Art publishes editorial content about embroidery, textile art, handmade decor, and DIY craft — including techniques, project ideas, patterns, and visual inspiration.

All content is provided for general informational and inspirational purposes only. We make no representation or warranty that any technique, material, pattern, or project described on the Site will produce a particular result, is suitable for your skill level, or is appropriate for any specific purpose.

04Craft and materials safety

To the fullest extent permitted by law, we disclaim all liability for any injury, loss, or damage arising from your use of, or reliance on, any content on the Site.

05Intellectual property

5.1 Our content

All content published on the Site — including but not limited to written articles, photographs, illustrations, textile and embroidery designs, patterns, graphics, layouts, logos, the “Modern Fiber Art” name and branding, and the compilation and arrangement of all of the foregoing (collectively, the “Content”) — is owned by us or properly licensed to us, and is protected by copyright, trademark, and other intellectual property laws.

5.2 What you may do

We grant you a limited, non-exclusive, non-transferable, revocable licence to access the Site and view, download, and print Content for your own personal, non-commercial use only.

You may make items for your own personal use based on techniques or ideas described on the Site.

You may share a link to any page on the Site, and you may pin our images to Pinterest using our on-page sharing features or standard pinning tools, provided the pin links back to the original page on the Site and no attribution is removed or altered.

5.3 What you may not do

Without our prior written permission, you must not:

• Reproduce, republish, redistribute, mirror, syndicate, or scrape any Content, in whole or in substantial part, on any other website, platform, publication, or medium;
• Remove, obscure, or alter any copyright notice, watermark, byline, or attribution;
• Use any Content for commercial purposes, including in advertising, marketing, printed goods, or resale;
• Use any Content, in whole or in part, to train, fine-tune, evaluate, or otherwise develop any machine learning model, artificial intelligence system, large language model, or dataset;
• Use automated means — including bots, crawlers, scrapers, or data-extraction tools — to access, copy, index, or collect Content, except that we permit standard search engine crawlers that respect our robots.txt file;
• Frame, inline-link, or embed the Site or any Content in a way that misrepresents its source or removes it from its original context;
• Create derivative works from our patterns, designs, photographs, or written Content for distribution or sale.

Nothing in these Terms grants you any right, title, or interest in the Content beyond the limited licence expressly stated above.

5.4 Copyright complaints

If you believe Content on the Site infringes your copyright, contact us at hello@modernfiberart.com with a description of the work, the location of the allegedly infringing material, your contact details, and a statement of your good-faith belief that the use is unauthorised.

06User submissions

If the Site allows you to submit comments, images, project photographs, messages, or other material (“Submissions”), the following applies.

You retain ownership of your Submissions. By posting or sending a Submission, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable licence to use, reproduce, adapt, publish, display, and distribute that Submission in connection with operating and promoting the Site.

You represent and warrant that you own or have all necessary rights to your Submission, and that it does not infringe any third party’s rights.

You must not submit material that is unlawful, defamatory, obscene, harassing, hateful, misleading, infringing, or that contains malware, spam, or unsolicited promotion.

We may remove, edit, or refuse any Submission at our sole discretion, without notice and without obligation to give reasons. We do not pre-screen Submissions and are not responsible for their content.

07Advertising

The Site is supported in part by advertising. We display advertisements served by Google through Google AdSense, Google Ad Manager, and related Google advertising services, and may work with other advertising partners from time to time.

These partners may use cookies, pixels, device identifiers, and similar technologies to serve, personalise, measure, and report on advertising. Their collection and use of data is governed by their own privacy policies, not ours. See our Privacy Notice and Cookie Notice for further detail and for your opt-out options.

We do not control and are not responsible for the content of any advertisement, or for the products, services, or practices of any advertiser. Any dealing you have with an advertiser is solely between you and that advertiser.

08Reader support, content access, and payments

We use Google’s Reader Revenue Manager and related Google services to offer reader-facing features on the Site. These may include newsletter sign-up prompts, reader registration, surveys, rewarded-ad content access, contributions, and subscriptions.

8.1 Registration and Google accounts

Some features may require you to sign in with a Google Account. Your use of your Google Account is governed by Google’s own terms and privacy policy. We do not receive or store your Google Account password.

8.2 Rewarded ad access

Where offered, we may allow you to access certain Content by voluntarily choosing to view an advertisement. This choice is always optional and you may decline it. Ad availability is determined by our advertising partners and is not guaranteed.

8.3 Contributions and subscriptions

Where offered, contributions and subscriptions are processed by Google using Google Pay and Google’s payment systems. We do not receive, process, or store your full payment card details.

• Prices are shown at the point of purchase and are inclusive or exclusive of tax as indicated there.
• Subscriptions, where offered, renew automatically on the stated billing cycle until cancelled. You may cancel at any time through your Google Account subscription settings; cancellation takes effect at the end of the current billing period.
• Contributions are voluntary payments in support of our work. They are not tax-deductible charitable donations and do not purchase any specific product or service.
• Refunds are handled in accordance with Google’s applicable refund policies and any mandatory consumer rights available to you under the law of your jurisdiction. Contact us at hello@modernfiberart.com if you have a billing question and we will assist where we are able.

8.4 Changes to access features

We may add, modify, suspend, or discontinue any reader-facing feature, prompt, paywall, or access model at any time. Where you hold an active paid subscription, we will not remove access you have already paid for without providing a pro-rata refund or equivalent remedy.

09Affiliate links and material connections

The Site contains or may contain affiliate links. If you click certain links to third-party retailers and make a purchase, we may earn a commission at no additional cost to you.

We may also publish sponsored content, gifted-product reviews, or brand partnerships. Where a material connection exists, we disclose it in or near the relevant content.

Affiliate relationships do not change our editorial views, and we are not responsible for the products, pricing, availability, shipping, or customer service of any third-party retailer.

10Third-party links and services

The Site links to third-party websites, services, and platforms, including Pinterest. We do not control these and do not endorse them by linking to them. We are not responsible for their content, accuracy, availability, security, or privacy practices. Your use of any third-party site is at your own risk and subject to that site’s own terms.

11Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorised access to the Site, its servers, or any connected system;
• Interfere with, disrupt, overload, or impair the Site or its infrastructure;
• Introduce viruses, malware, or other harmful code;
• Circumvent, disable, or interfere with any security feature, access control, paywall, registration wall, advertising, or usage limitation on the Site;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Collect or harvest personal information about other users;
• Use the Site in any way that could damage, disable, or impair it, or interfere with any other party’s use of it.

12Availability and changes to the Site

We provide the Site on an “as available” basis. We may change, suspend, or discontinue any part of the Site — including any Content, feature, or service — at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation.

We do not guarantee that the Site will be uninterrupted, timely, secure, or error-free, or that any defect will be corrected.

13Disclaimer of warranties

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, some of the above exclusions may not apply to you, and nothing in these Terms limits any non-waivable statutory rights you have as a consumer.

14Limitation of liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.

15Indemnification

You agree to defend, indemnify, and hold harmless Modern Fiber Art and its owners, contributors, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of the Site, your Submissions, your breach of these Terms, or your violation of any law or third-party right.

16Termination

We may suspend or terminate your access to the Site at any time, without notice or liability, for any reason, including breach of these Terms. Sections 5, 6, 13, 14, 15, 17, and 18 survive termination.

17Governing law and disputes

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles.

You agree that any dispute will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

If you are a consumer resident in the European Economic Area, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings in your local courts or to the benefit of mandatory local consumer protections, nothing in this section deprives you of those rights.

18General

Changes to these Terms. We may revise these Terms at any time by posting an updated version with a new “Last updated” date. Material changes will be indicated by that date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

Entire agreement. These Terms, together with our Privacy Notice and Cookie Notice, constitute the entire agreement between you and us regarding the Site.

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms. We may assign them freely, including in connection with a merger, acquisition, or sale of assets.

No agency. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and us.
